By accessing the Funlus.com web site ("Site") or using the services offered by Funlus corporation ("Services") or ("Group") you agree and acknowledge to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms or to our Privacy Statement, please do not access the Site or use the Services. Funlus.com reserves the right to change these Terms at any time. We recommend that you periodically check this Site for changes.

1. Usage License

Funlus.com grants you a limited license to access the Site and use the Services in accordance with these Terms and the instructions and guidelines posted on the Site. Funlus.com reserves the rights to terminate your license to use the Site and Services at any time and for any reason or in the future charge for commercial usage.

You are solely responsible for your use of the Site and Services. Because Funlus.com merely serves as a repository of information, user-posted content does not represent the advice, views, opinions or beliefs of Funlus.com, and Funlus.com makes no claim of accuracy of any user-posted material. Funlus.com allows for the posting of links to third-party web sites. The linked web sites content, business practices and privacy policies are not under our control, and we are not responsible for the content of any linked web site or any link contained in a linked web site. The inclusion of a link on the Site or Services does not imply any endorsement by or any affiliation with Funlus.com.

3. User-Posted Content

By posting content, you are granting permission to us and others to access and use it in connection with the Services, the Site and otherwise in connection with our business. Funlus.com is explicitly not responsible for the manner or circumstances by which third parties access or use public content and is under no obligation to disable or otherwise restrict this access. Funlus.com provides you with the ability to retrieve and remove your posted content and your personal information from the Site and the Services. This ability does not extend to copies that others may have made or to copies that we may have made for backup purposes.

4. No Warranty and Limitation of Liability

FUNLUS.COM PROVIDES THE SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. FUNLUS.COM SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, INFORMATION ACCURACY, INTEGRATION, INTEROPERABILITY OR QUIET ENJOYMENT.

You understand and agree that you use the Site and Services at your own discretion and risk and that you will be solely responsible for any damages that arise from such use. UNDER NO CIRCUMSTANCES SHALL FUNLUS.COM BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND, OR ANY OTHER DAMAGES WHATSOEVER (HOWEVER ARISING, INCLUDING BY NEGLIGENCE), INCLUDING WITHOUT LIMITATION, DAMAGES RELATED TO USE, MISUSE, RELIANCE ON, INABILITY TO USE AND INTERRUPTION, SUSPENSION, OR TERMINATION OF THE SITE OR SERVICES, DAMAGES INCURRED THROUGH ANY LINKS PROVIDED ON THE SITE AND THE NONPERFORMANCE THEREOF AND DAMAGES RESULTING FROM LOSS OF USE, SALES, DATA, GOODWILL OR PROFITS, WHETHER OR NOT FUNLUS.COM HAS BEEN ADVISED OF SUCH POSSIBILITY. YOUR ONLY RIGHT WITH RESPECT TO ANY DISSATISFACTION WITH THIS SITE OR SERVICES OR WITH FUNLUS.COM SHALL BE TO TERMINATE USE OF THIS SITE AND SERVICES.

5. Force Majeure

You acknowledge and understand that if Funlus.com is unable to provide the services as a result of a force majeure event Funlus.com will not be in breach of any of its obligations towards You under these Terms of Service. A force majeure event means any event beyond the control of Funlus.com. In the event Funlus.com is affected by a force majeure event, it shall promptly notify You of the estimated extent and duration of its inability to perform or delay in performing its obligations, on a reasonable efforts basis. FUNLUS.COM SHALL NOT HAVE ANY LIABILITY TO YOU WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER FORM OF LIABILITY FOR FAILING TO PERFORM ITS OBLIGATIONS UNDER THIS AGREEMENT TO THE EXTENT THAT SUCH FAILURE IS AS A RESULT OF A FORCE MAJEURE EVENT.

6. Copyright and trademarks

The terms Funlus.com, Funlus and any other marks used by Group are the trade marks, service marks and/or trade names of the Group or one of its subsidiaries or associated companies or its licensors. Further, all other material used by Group, including but not limited to the software, images, pictures, graphics, photographs, animations, videos, music, audio, text (and any intellectual property rights in and to any of the same) is owned by the Group or one of its subsidiaries or associated group companies and/or licensors and is protected by copyright and/or other intellectual property rights. You obtain no rights in such copyright material or trade or service marks and must not use them without the Group's written permission.

7. Other

Funlus.com and you are independent entities, and nothing in the Terms, or via use of the Site or Services, will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between Funlus.com and you.

6.1 Server Abuse
Any attempt to undermine or cause harm to our server Funlus.com is strictly prohibited.

6.2 Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.

6.3 Billing
Funlus.com shall deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services. When an invoice is delivered to the client, payment shall be remitted to Funlus by no later than the specified payment due date. (Does not include money deposits)

6.4 Cancellation Refunds (FAN)
We refund your Funlus advertising network money, if you:
- fill in an refund-application
- pay our refund-service fee (currently 10 euros)

Note! We did not refund:
- Starting fees
- Service fees
- Bonus credits

Funlus.com reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification.
